NON-COMMERCIAL USE END-USER LICENSE AGREEMENT FOR Little Turtle Knits Patterns
By purchasing, downloading, printing or otherwise utilizing a Little Turtle Knits pattern, you agree to be bound by the terms of this Non-Commercial Use End-User License Agreement (EULA). If you do not agree with the terms of this EULA, you may not purchase or use the pattern(s).
1. NON-COMMERCIAL USE: This EULA intends to make it easy for crafters to use Little Turtle Knits’ patterns for Non-Commercial Purposes, where "Non-Commercial Purposes" means:
To be used by an individual crafter for personal purposes, and where "Non-Commercial Purposes" specifically excludes any use for commercial gain, whether to be sold or to be used to craft items for same, or to be used within a company, partnership, organization or entity that transacts commercial business.
2. GRANT OF LICENSE: This EULA grants you the following non-exclusive rights:
You may use the pattern(s) an unlimited number of times for personal crafting, or for charitable giving, so long as every use of the pattern is for NON-COMMERCIAL PURPOSES.
Unless expressly permitted under this EULA, you will not:
alter, remove, hide or cover proprietary notices or copyright notices in or on the pattern.
alter the pattern in any way for inclusion in any other venue outside of the original digital download.
duplicate the pattern for distribution purposes
distribute the pattern to third parties
make use of the pattern for commercial gain, whether directly, indirectly or incidentally.
Rent or lease the pattern
3. TERMINATION
Without prejudice to any other rights, Little Turtle Knits may terminate this EULA if you fail to comply with the terms and conditions of this EULA. In such event, you must destroy all copies of the pattern in your possession.
4. COPYRIGHT
All title, including but not limited to copyrights, in and to the pattern(s) and any copies thereof are owned by Little Turtle Knits or its suppliers. All title and intellectual property rights in and to the content which may be accessed through use of the pattern(s) is the property of the respective content owner and may be protected by applicable copyright or other intellectual property laws and treaties. This EULA grants you no rights to use such content. All rights not expressly granted are reserved by Little Turtle Knits.
5. LIABILITY:
THIS PATTERN IS PROVIDED ``AS IS'' AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED. IN NO EVENT SHALL THERESA BELVILLE OR LITTLE TURTLE KNITS. BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, HOWEVER CAUSED AND ON ANY THEOR OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THIS PATTERN.
6. All pattern sales are final - due to the downloadable, instant nature of our patterns, we are unable to offer refunds or excahnges on any pattern PDFS.
